Please read these Terms of Service carefully before using Extensight. By accessing or using our platform, you agree to be bound by these terms. If you do not agree, do not use the service.

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you or the organization you represent ("Customer," "you," or "your") and Extensight ("Extensight," "we," "us," or "our") governing your access to and use of the Extensight platform, software agents, APIs, and related services (collectively, the "Service").

By creating an account, installing an agent, or otherwise accessing the Service, you represent that you have the authority to bind yourself or your organization to these Terms.

3.1 Account Registration

To use the Service, you must create an account with accurate and complete information. You are responsible for maintaining the security of your account credentials, including passwords and API keys.

3.2 Authorized Users

You may invite users within your organization to access your account. You are responsible for ensuring all authorized users comply with these Terms. Each user must have valid login credentials and must not share credentials with others.

3.3 Device Limits

Your subscription plan includes a device limit. Exceeding your device limit does not immediately terminate service but will be flagged in your dashboard and our administrative console. Continued over-limit usage may require plan upgrade or result in service suspension.

5. Agent Software and Endpoint Deployment

5.1 Installation Requirements

The Extensight agent must only be installed on devices owned by or under the control of your organization. You are solely responsible for obtaining any necessary consents from device users in compliance with applicable employment, privacy, and data protection laws.

5.2 Policy Enforcement

The Service may enforce browser extension policies on enrolled devices, including blocking or removing extensions. You are responsible for ensuring that your use of policy enforcement features complies with applicable laws and any agreements with device users.

5.3 Agent Updates

We may release updated agent binaries from time to time. You are responsible for deploying updated agents to your enrolled devices. We are not responsible for issues arising from outdated agent software.

6. Data and Privacy

6.1 Data Collection

The Extensight agent collects information about browser extensions installed on enrolled devices, including extension names, IDs, versions, permissions, and associated hostnames and usernames. This data is transmitted to our servers and displayed in your dashboard.

6.2 Data Ownership

You retain ownership of all data collected from your organization's devices. We process this data solely to provide the Service and as described in our Privacy Policy.

6.3 Data Security

We implement reasonable technical and organizational measures to protect your data. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.

6.4 Data Retention and Deletion

We retain your data for as long as your account is active. When an account is deleted, all associated data is permanently deleted from our primary systems immediately, including all devices, extensions, users, policies, and integration settings. Residual copies may persist in database backups for up to 90 days before being overwritten by backup rotation.

Account deletion is performed by Extensight administrators upon request. To request deletion, contact support@extensight.com. We do not offer self-serve account deletion. We will process deletion requests within 30 days of receipt.

7. Subscription, Billing, and Plans

7.1 Plans and Pricing

The Service is offered under various subscription plans with different device limits and features. Current plan details are available on our website and in your account dashboard.

7.2 Trial Accounts

Trial accounts are provided at no charge and are limited to 25 devices. Trial accounts may be converted to paid plans at any time. We reserve the right to terminate trial accounts that have been inactive for 30 days.

7.3 Payment

Paid subscriptions are billed in advance. All fees are non-refundable except as required by law or as explicitly stated in a separate agreement. You are responsible for all applicable taxes.

7.4 Plan Changes

You may upgrade or downgrade your plan at any time. Upgrades take effect immediately. Downgrades take effect at the start of the next billing period.

8. Intellectual Property

The Service, including all software, designs, trademarks, and content, is owned by Extensight and protected by intellectual property laws. These Terms do not grant you any rights to our intellectual property except the limited license to use the Service as described herein.

You grant us a non-exclusive, royalty-free license to process and display data you submit through the Service solely for the purpose of providing the Service to you.

9. Third-Party Integrations

The Service may integrate with third-party services such as Slack, SIEM platforms, and Okta. Your use of such integrations is subject to the terms and privacy policies of those third parties. We are not responsible for the practices or availability of third-party services.

10. Disclaimers and Limitation of Liability

10.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

10.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EXTENSIGHT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO EXTENSIGHT IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Extensight and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or third-party rights; or (d) data you submit through the Service.

12. Term and Termination

12.1 Term

These Terms remain in effect for as long as you use the Service or maintain an account.

12.2 Termination by You

You may terminate your account at any time by contacting us at legal@extensight.com. Termination does not entitle you to a refund of prepaid fees.

12.3 Termination by Us

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or if required by law. We may also terminate the Service entirely with 30 days notice.

13. Modifications to Terms

We may modify these Terms at any time. We will provide notice of material changes by email or through the Service. Your continued use of the Service after the effective date of changes constitutes acceptance of the updated Terms.

14. Governing Law and Disputes

These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Massachusetts, and you consent to personal jurisdiction in those courts.

15. General Provisions

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Extensight regarding the Service. If any provision is found unenforceable, the remaining provisions remain in full force. Our failure to enforce any provision is not a waiver of our right to do so in the future. You may not assign these Terms without our prior written consent.
